Terms of Service

1. Acceptance
By creating an account or using Brank, you agree to these Terms of Service. If you are using Brank on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree to these terms, do not use Brank.
2. The service
Brank Ltd provides brand kit management software via brank.app ("the Service"). We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these terms. We may update, improve, or discontinue features of the Service at any time.
3. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@brank.app if you suspect unauthorised access. You must be at least 16 years old to use Brank.
4. Your content
You retain all rights to the content you upload to Brank: colours, logos, images, and text. By uploading content, you grant Brank a limited licence to store and display it for the purpose of providing the Service. We do not claim ownership of your content and do not use it for any purpose other than operating the Service.
5. Acceptable use
You may not use Brank to upload or share content that infringes third-party intellectual property rights, contains malware or malicious code, or violates applicable law. We reserve the right to remove content that violates these terms and to suspend or terminate accounts that repeatedly breach them.
6. Subscriptions and billing
Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by law. If you cancel, your subscription remains active until the end of the current billing period. We may change pricing with 30 days notice. Annual subscribers will be notified before their renewal at the new price.
7. Free plan
The free plan is provided without charge and without any service level commitments. We may discontinue the free plan or change its features with 30 days notice. Free plan data is retained as long as your account is active.
8. Availability
We aim for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance where possible. Our current uptime history is published at brank.app/status.
9. Limitation of liability
To the maximum extent permitted by law, Brank Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, lost profits, or business interruption. Our total liability to you for direct damages is limited to the amount you have paid us in the 12 months preceding the claim.
10. Governing law
These terms are governed by English law. Any disputes arising from or related to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date of any change constitutes acceptance of the updated terms.
